Texting Privacy Policy

Effective Date: September 01, 2025

At GruupMeet (collectively, "GruupMeet" or the "Company"), we are dedicated to protecting the privacy and security of your personal data. This Texting Privacy Policy ("Privacy Policy") explains how we collect, use, and safeguard the information we gather when we facilitate 2-way texting to our customers and their clients ("you", "Client", or "Customer") for customer support and event-related communications via our enterprise events platform. Please read this policy carefully to understand our practices regarding your personal information and how we will treat it.

By providing us with your phone number or the phone numbers of your Clients (by being a Customer of GruupMeet or by contacting the Company and agreeing to receive text messages), you consent to the collection, use, and processing of this data as outlined in this Privacy Policy, along with the Terms and the above or below Terms of Use, Exhibits, Policies, Invoice, and/or attachments. This consent must comply with all Applicable Laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, General Data Protection Regulation (GDPR), and state law requirements such as Quiet Hours restrictions.

As a Client, you are responsible for the content of any communication that goes out via email or texting. You and/or your Customer are also responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply. You and/or your Customer will receive messages as needed for customer support, event-related updates, and if you have explicitly opted in for promotional or marketing text messages about new features, services, or offers. GruupMeet's 2-way texting is used only for service-related updates (e.g., event schedule changes, logistical reminders, flight info, or other Operational Messages), unless separate prior express written consent has been obtained for Marketing Messages.

Information We Collect

One of the key features of the GruupMeet application is the ability for our Clients to communicate with their Customers by sending relevant text messages pertaining to the event in which the Customer is a participant, using our 2-way texting functionality as part of our enterprise events platform.

We collect several types of information when facilitating 2-way texting to Customers and their Clients. This information helps us provide customer support, event-related communications, and ensure compliance with Applicable Laws:

How We Use Your Information

We use the information we collect in a variety of ways, primarily to provide effective customer support and event-related services via our enterprise events platform, while ensuring compliance with Applicable Laws:

  • Provide Customer Support and Operational Messages: We use your contact information and the information about your Clients (if applicable) to send text messages regarding customer support requests, status updates, troubleshooting steps, or Operational Messages (informational, non-commercial messages whose primary purpose is to facilitate a previously agreed-upon event or transaction, such as event schedule changes or logistical reminders). You may text "HELP" to any message sent by GruupMeet to you or your Customer for assistance. You and/or your Clients may receive messages weekly or as needed for customer support or events.

Our goal is to resolve any issues quickly and effectively through 2‑way texting, keeping you and your Clients informed at each stage.

  • When messages qualify as Operational Messages (in reference to Texas Business & Commerce Code § 302.001(7) and as defined in the Messaging Acceptable Use Policy and), they are exempt from Texas SB 140 (effective September 1, 2025) quiet‑hour restrictions because they are not intended to encourage any purchase, rental, or investment in goods or services.
  • When messages are Marketing Messages, they must comply with all applicable quiet‑hour restrictions and consent requirements.

This distinction ensures that time‑critical operational updates (e.g., flight delays, shuttle changes) can be delivered promptly, while marketing content remains compliant with Texas law.

Customer Information

  • Contact Information: When you, as our Customer, provide your contact details, such as a phone number, we collect and use that information to send text communications related to customer support or Operational Messages.
  • Account Information: In certain cases, we may collect information about the services you have with us, your service preferences, or your account status to tailor customer support or event-related messages.
  • Communication History: We may store details about previous communications, including text message content, so we can provide relevant support, improve our services, and maintain Consent Records as required by Applicable Laws.

Client Information

  • Client Contact Information: If you are a business Customer of GruupMeet and provide us with your Clients' phone numbers for the purpose of customer support or event-related communication, we will collect and use this information only to send text messages related to support inquiries, issues, or Operational Messages.
  • Client Service History: If you provide us with information about the issues your Clients are facing or event details, we may use this information to send tailored support or logistical messages to your Clients.

Texting Communication Data

  • Message Content: The content of the text messages sent (including any inquiries, requests, or feedback received through 2-way texting) may be collected for the purpose of delivering customer support, tracking the status of issues, and documenting Consent Records.
  • Response Data: If you or your Clients respond to text messages, we may collect those responses to further assist with ongoing customer support, event logistics, or to improve our services.
  • Customer Data: This includes non-public data provided by you to GruupMeet to enable the provision of the Services, and data generated from your use of the Services that is based on or derived from such data.

Respond to Inquiries

We use the information to respond to any inquiries made via texting or to initiate texting conversations for support or event-related purposes. This ensures that all support-related or logistical queries are addressed promptly and accurately.

Service Update

We may send text alerts for scheduled maintenance, outages, service updates, or other notifications related to our services or events. These notifications may be sent to both you and your Clients to ensure everyone is aware of important developments.

These notifications may be sent to both you and your Clients to ensure everyone is aware of important developments.

Improve Customer Experience

By reviewing the content and responses to text messages, we can analyze and improve the quality of our customer service and event platform. We use this data to identify trends, optimize communication strategies, and provide better support in the future.

Marketing and Promotions (Optional)

Marketing Messages (messages whose primary purpose is to promote or sell a product, service, or brand, such as promotions for future events, partner offers, or post-event solicitations) require separate prior express written consent. An event or service sign-up does not constitute implied consent to receive Marketing Messages unless expressly and separately agreed to by the recipient. Consent collected during sign-up, registration, or purchase authorizes only Operational Messages related to that event or service. If you have explicitly opted in with separate, verifiable consent, we may send promotional or marketing text messages about new features, services, or offers. You have the option to opt-out of marketing communications at any time by replying "STOP", "END", "CANCEL", "UNSUBSCRIBE", or "QUIT" to the text message.

How We Protect Your Information

We take reasonable steps to ensure the protection of your personal information. The security of your data is a top priority, and we take various measures to minimize the risk of unauthorized access or misuse:

Encryption and Security

We use encryption protocols to protect personal information during transmission. We implement security measures to prevent unauthorized access to systems that store your data.

Data Access Control

Access to your personal data is restricted to authorized personnel who need the information to perform customer support or event-related services. We use secure authentication and role-based access control to limit access.

Data Minimization

We collect only the information necessary to provide customer support, event communications, and related services, and we avoid storing sensitive data unless required by law or necessary for operational purposes.

Consent

By providing us with your phone number or the phone numbers of your Clients, you consent to the collection, use, and processing of this data as outlined in this Privacy Policy. Additionally, by sending or receiving text messages, you consent to the use of 2-way texting as a communication method. You must obtain separate, verifiable, legally compliant consent for each category of message (Operational Messages vs. Marketing Messages). Where required by law, consent must be specific to the communication channel (e.g., texting). A Consent Record is a verifiable, legally compliant record of a recipient’s consent to receive communications, containing required data points such as date, time, method of consent, and specific permissions.

Consent for Operational Messages may be obtained as part of event registration or service enrollment, provided it is clear to the recipient that such messages are solely for service‑related updates.

Opting Out

If you no longer wish to receive customer support-related or event-related text messages, you or your Clients may opt out by replying "STOP", "END", "CANCEL", "UNSUBSCRIBE", or "QUIT" to any text message. After opting out, you will no longer receive non-essential text communications. However, you may still receive critical messages (such as service alerts or legal communications).

Revocation of Consent

You or your Clients may withdraw consent at any time, which will stop future marketing or promotional communications. This can be done by following the opt-out instructions included in each message. We will maintain records of all opt-outs as part of Consent Records to ensure compliance.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected or as required by Applicable Laws. Once we no longer need your personal data, we securely delete or anonymize it.

Retention Period

We generally retain personal data only for as long as is required to respond to support requests, manage events, or to comply with legal obligations. Data retention periods may vary depending on the nature of the service or the request.

Data Disposal

Once the retention period has expired, we will securely dispose of or anonymize any personal information we no longer need.

Third-Party Services

We may use third-party service providers to assist in facilitating 2-way texting or storing communication data. These third parties may have access to personal information, but they are obligated to protect it in accordance with Applicable Laws and our agreements with them. We do not share your mobile information with third parties for marketing purposes, and data sharing is strictly limited to providing our services.

Service Providers

We use reputable texting platforms that comply with industry security standards to ensure the safe transmission of messages. We commit not to transfer your personal data to external organizations without your consent, except as necessary to provide our services and with strict confidentiality agreements in place.

Our third-party providers are contractually obligated to comply with data protection regulations and are prohibited from using personal data for any purposes other than those specified by us.

Legal Compliance

In some cases, we may need to share your information with third parties if required by law, such as to comply with subpoenas, legal processes, or to protect the rights, property, or safety of GruupMeet, our Customers, or others. All communications must adhere to Applicable Laws, including TCPA and state law Quiet Hours.

Your Rights

Depending on your jurisdiction, you may have certain rights regarding your personal data, including:

  • Right to Access: You have the right to request access to the personal data we hold about you. This may include information on how your data is used and with whom it is shared.

  • Right to Rectification: If your personal data is inaccurate or incomplete, you have the right to request correction or updates.

  • Right to Deletion: You have the right to request that we delete your personal information, subject to certain exceptions (e.g., if we need to retain it for legal reasons).

  • Right to Object or Restrict Processing: You may object to the processing of your personal information or request that we restrict how we use your data in certain circumstances.

  • Right to Data Portability: If applicable, you have the right to receive a copy of your data in a structured, commonly used, and machine-readable format, and to transfer it to another data controller.

If you would like to exercise any of these rights, please contact us at the information provided below.

Changes to This Privacy Policy

We may update or amend this Texting Privacy Policy from time to time. If we make material changes, we will notify you via text message or update the date at the top of this policy. Please review this policy periodically to stay informed about how we are protecting your information.
